Digital TV and February 17, 2009

On February 8th 1996, then President Bill Clinton signed into law the Telecommunications Act of 1996 that had been approved by the United States 104th Congress, on the same day in history on which the first proceeding of of the U.S. Congress was first televised in 1947 Isn't that an irony. 

A little history on the background of this Congressional Act and how it was approved in Congress.  "Wireless communications companies offering cellular phones, mobile radio, personal communications systems and the like were having two kinds of problems. They needed to blanket an area quickly with strategically located base transmitters, so that their customers could enjoy service throughout the whole area, but they were running into local opposition to the erection of towers carrying these transmitters. Also, they needed to interconnect with existing telephone companies in order to serve their customers, but wanted exclusion from long-distance equal access requirements and from local exchange carrier interconnection obligations.  

So they lobbied Congress to legislate these problems out of existence. Congress obliged by passing the TC Act. Congress obliged the industry and was railroaded, when the TC Act came to the floor for a vote.  Usually, the members of Congress are given some time to read a bill and consider it, before voting on it. But that was not true for the TC Act. In both the House and the Senate, there was about an hour and a half of debate on it, and then the vote was taken. Not a single member of Congress had had an opportunity to read the bill that was being voted on. (Congressional Record, February 1, 1996, pages S686-S721 and Hi 145-Hi 179.)"

A loophole was interweaved into the initial legislation to allow Congress to alter the deployment date of this legislation at the convenience of the telecommunication industry.  Well finally that day is approaching and on February 17, 2009 all full-power broadcast television stations in the United States will stop broadcasting on analog signals the airwaves will become digital.

Lightweight Champion Armando Ramos Dead

One of the greatest professional boxers of all time died on Saturday July 6, 2008.  Born in Long Beach, California on November 15, 1948, Armando "Playboy" Ramos was one of the top boxers on the West Coast. 

Using a forged birth certificate he established himself as the youngest Lightweight Champion in history and dominated his division up until about 1970.  He was a staple on the main event card at the historic Olympic Auditorium in Los Angeles for many years, often destroying his opponents and earning as much as $100,000 a night for many of his fights. 

As a young fighter in his teens, his fight purses were almost as large as Cassius Clay (later changed his name to Muhammad Ali).  During his hey day he was earning more money than Mickey Mantle, Sandy Koufax, Wilt The Stilt and Broadway Joseph Willie Namath.

Selecting Bed Partners Can Come With Risks

Sunday is like a kickback day church; practice a little music and just chill.  The day always start with checking the net for our ranking since most updates are made over the weekend.

I ran into the above link, as inside of it was a link to our site posted by an anonymous poster with poor spelling habits. 

Apparent there was a deal between ActiveRain and Move.com that has resulted in a $33 million breach of contract litigation. 

Is anyone up on this and able to shine any light on where this stands and how this may impact the Activerain site?  I'm never amazed anymore as to what I find when I peruse the web and perform counter intelligence on our web properties. 

From what I've read it sounds like you have to be selective in picking your bed partners and selective on the info you release before the marriage, ouch!

Are we setting future generations up for a catch 22?

Education is an essential foundation for personal, social and economic success in a globalize economy.  The United States spends more public and private money on education than other major countries, but its performance doesn't measure up in areas ranging from high-school graduation rates to test scores in math, reading and science, according to a new report from the Paris-based Organization for Economic Cooperation and Development, which produces an annual education review of industrialized nations.

What are the prospects for the real estate industry if this trend continues?  Will Americans have the wherewithal and capacity to afford homes at current or future prices?

If this trend continue would you advise or counsel your children and/or grandchildren to enter the real estate profession or just get a job that is not real estate related?

Stiff competition for qualified buyers would seem to be a criterion for frustration as well as being a ripe formula for career burnout.

Given the fact that market prices in many regions of the country have severely outpaced income and the currently reduced market prices still exceed most buyers' ability to qualify for financing.  One or two more trends (price increases) like we experienced from (1973 - 1979) and from (1999 - 2004), would seem to make home ownership more of a dream than a reality. The disparity in income and wealth (between the haves and have nots) in my opinion will become quite evident and effect homeownership issues as history moves forward

As a grandfather of 6 jewels, I'm concerned as to the quality of life my young ones will live and would truly hope we're not ruining their future with decisions being made today.  Once a million dollars become the median home price, $15 gas becomes the norm and wages continue to lag like they always have, what quality of life will they experience, other than the new tech toys and gadgets that come onto the market?

I guess an even better question is do we really care as to the future we leave our children's children.  This discourse has not even considered the environmental climate, which had its own quality of life issues.

Generosity and Patriotism

US Flag

Lots of times inferences are made in spite of what the raw data would suggest other wise.  I've always felt it was in the interest of quality of life to raise the consciousness of our nation and people.  I've read in many places as how the United States was one of the most giving nations in the world.  Well, well, well!   Being a nose body and waking us early, I decided to test my assumptions against researched facts. 

United States ranks third in the incidences of lung caner.  You would think that since we have one of the highest educated population in the world and spend tons of money advertising against smoking and have a awesome appeal to look the Hollywood part that we would not be in the top ten.  Sorry, we're #3. 

Breast cancer awareness is all over map making inroads and raising monies through sponsored walks and even going pink of Activerain. You'd have to feel those millions of dollars are making some kind of impact.  Nope, we're #3 again. 

However we are at #6 on the charts as being one of the richest countries in the world, we have buck-ko-roos, dineros, dollars, cash or bling.  Yet when it comes to compassion, we re at #18.  Remind you all the other charts stop at 10  and the chart represent giving of all types.   We had to extend this chart to 20 just for the United States to show up.  

I think this performance disgraces our wealth and education and displays us as a selffish nation and I would go on record as saying a little greedy society who professes our virtues to be different than our reality.  We have one of the highest incidences of disease per individual in our population in the world.  Yet we contribute so little to of our treasure for the betterment of mankind.  

I know we can do better, I feel we ought to do better and solicit all to make it a reality to do better.  Too many of us act on what we think to be real rather that the reality of the facts.  This will become quite important in a few years when many of our troops who are fighting in distant countries return to civilian life and require compassion.  

They will have honored our country and may themselves fall upon hard times as a consequence of the sacrifices that have made to allow us to enjoy a Bar-B-Que and fireworks on this Fourth of July.  As you enjoy and partake in festivities, challenge yourself and your family to raise the moral bar on charity and not play lip service based on innuendo and false beliefs. 

I wish you all a Happy Fourth of July.  Don't burn the Bar-B-Que and open your hearts to reach out and share part of your treasure, time and talent to a worthy cause.

80/20 Rule in Full Effect

There are over 25 million small businesses in the United States.  These businesses collectively generate in excess of $5.5 trillion in sales and employ more than half of all private sector employees.  Here are the statistics that we have all heard them many times.  80% of all new business start-ups are out of business within five years. And, 80% of the 20% that survived won't survive in another five years!  This means that, on average, only 4% of small businesses starting this year will be around 10 years from now. 

With that said entrepreneurism is alive, well and still kicking.  We are a country of dreamers and risk finances, relationships, health and mental sanity to fulfill our dreams, in spite of the odds or challenges. 

I never knew when I was first introduced to the 80/20 rules how many areas of life it impacted.  See, I was a Marine and was introduced to the 10% rule way before acquiring knowledge of the 80/20 rule.  Any good Marine will know what the 10% rule is!

DUI can = 1st degree MURDER

Everyone is aware of the hands free law that went into effect today in California.  Another law that will severely impact drivers also went in effect today.  

If you drink, drive drunk and are involved in an auto accident that kills someone, you can be charged with 1st degree MURDER. 

You will be required from today going forward to sign a declaration to state you understand this when renewing or getting a new driver's license. 

This will raise the ante for driving drunk or under the influence.  I'm wondering why it is not being advertised as much as the hands free law. 

Caution:  CHP is out in force today enforcing the hands free law and have written citations along the 110 freeway.

Activerain - On The Right Path to Evolution!

As some may know needAnotary is one of the biggest fans and the greatest critic of Activerain.  Love it for it potential as a communication, marketing and search optimization tool.  But, will ding it when the system has flaws, malfunctions or gives effort messages.  So are the slings and arrows of technology.

The past two weeks have been terrific and the system has flowed link no body's business. I believe there were only two or three hiccups.

We'll continue being the greatest fan and biggest critic as the site evolve.  I look forward to using a new tool recently introduced Outside Blogs.  Being a little lazy, I don't believe in reinventing the wheel.  Brad Andersohn wrote an excellent article detailing this feature.  If you missed it here is the link (http://activerain.com/blogsview/571717/The-Evolution-of-the) for you to read this informative discourse.

2008 Summer Olympics

I don't know about you but I'm looking forward to the 2008 Olympics this summer.  I'm not into the basketball because my feelings are that America should reserve that event for college players.  It should be a reward for college players, especially seniors.  Many of the pros that will be on this year's team have no college experience, or when they were in college we not Olympic quality material.  I remember the days when we won in this sport with college palyers.  The horse is dead I'll get off of it now.

I will however be awfully excited about the field and track events.  I'm expecting a world record in the 100-meter sprint, as 3 of the fastest men in the world will be in competition.

America has Tyson Gay and the Jamaicans have Asafa Powell and Usain Bolt.  All of these cats have run world record or close to world record times lately.  This is raw speed, a blur and done!

Swimming, boxing and gymnastics are also events I enjoy watching, even though I don't know any of the athletes.

I notice that this year's Olympic is not as well promoted and marketed as in the summer games of 2004.  Marketing for the athletes started early in 2003 for the 2004 Olympic s, as I worked for a major sponsor of one of the athletes in that Olympic.  There were commercials all over radio, TV and in print for athletes and the games. 

I'm wondering why not so much fanfare this year.  If anyone has any feedback, I'd be interested in hearing it.

What are your favorite events and which athletes will you be looking favorable towards?  I'm not sure how the time difference will affect the television schedule especially events we see live.

FYI: The Big Roll Out

As many of you know California is rolling out 2 new laws on July 1, 2008, which, forbids motorist from talking on cell phones with out a hands free device.  

One law applies to motorist over 18 years of age and the other law is applicable to motorist under 18 years of age. 

To ensure motorist are enlightened the Amber Alert message boards on the freeway are providing warnings to drivers as they travel the highways and by ways of California. 

Driving while talking on a cell phoneThat is to be expected as they introduce to a new fad.  What I'm about to share now, I don't know if many folks know about or expect to happen. 

Some cities have recently purchased high-powered binoculars, video recorders and authorized baby-sitting for officers to make sure the public gets the message.  

Officers will be working in teams to stop offenders who just don't get it.  One officer will be designated and positioned to lookout and observer for drivers who are using cell phones while driving.  If a driver is spotted they will radio ahead to a team of motorcycle officers who will be positioned ahead in the directions the driver is traveling. 

The officers ahead will already know how long it will take you to reach their position along with the make of car and your license number.  Once you pass the designated point and are still on your phone, the officer will initiate a traffic stop. 

The officer after asking for you license will ask you where you contacting on the phone making andTraffic stop emergency call to a law enforcement agency, a medical provider, the fire department, or other emergency services agency.  If you answer yes they will ask for you to show the last number called from your phone.  If in fact you are truthful will be warned about the new law and sent on your way with being cited. 

If on the other hand you lie or say no, you will be issued a citiation.  If this is your first offense the base fine will $20.  If this is not your first offense the fine will be $50 for subsequent offenses.  If you notice I said base fine.  In California there is something called a penalty assessment which can cause the financial obligation to be more than triple the base fine. 

A $20 fine becomes about $93 if you are convicted or plead guilty.  That $50 second offense fine will total more than $161 if you are found guilty, plead guilty or no contest.  No contest is the same as pleading guilty, except that it cannot be held against you I a civil proceeding.  I'm not an attorney, but I think this will only apply if there is a collisions and someone's property is damaged and you are sued in civil court. 

The idea behind the use Day in Courtof enforcement muscle is to ensure that motorist get the message and refrain from driving and talking with a phone next to their ear and youth don't talk at all while driving.  Also they expect word of mouth to travel to help in assist in educating motorist while encourage drivers to be alert and not travel with phones glued to their ear. 

I learned of this technique as I stoped by the park today to play a couple hands of dominos by someone who was recently stopped and given notice of the new law, as officers were testing their systems and communications.  Here is the premise, if you are on a cell phone without a headset, it is highly likely that you will still be on the phone once you pass the second checkpoint. People are creatures of habit and more than likely you will pass that checkpoint yapping away, until you see the christmas trees and hear the siren to alert you to pull over.

I hope none on Activerain site become an example, as enforcement will help some cities offset the cost of enforcement activities.  If you havppen to get cited, please share your experience with the community.

Today when you speak with business owners here, there and yonder, a few things are clear business is slow, profit margins are squeezed, and customers have hidden agendas.

Right hand turn strategy saves millions in fuel cost.

They say you live and learn and I've found that to be true in the course of life's events today I learned something new.  As I think while researching and before writing this blog, this must be a strategy that has something to do with going green.  Everyone is going green today!  Maybe that is whyWhat has Brown done for you lately? Boston won the Championship.  I'm waiting for the commercials, tongue in cheek. 

I often notice as I pull up into an intersection whether there is glass or plastic or metal pieces lying in the middle of the intersections from a previous car crash, great way to get a slow leak or flat tire.  I was a bad boy once and was required to go to traffic school on a Saturday.  I spent the entire day in a hot crowded room listening to a guy trying to be funny when his jokes sucked.  But, I braved the experience and I learned something also on that day also.  The instructor said most traffic accidents occur in middle of intersections, especially when people making left turns.

Today I learned the UPS (What has Brown done for you lately?) uses a software program that pre-programs a driver's route in such a way there are no left turns or very few if any on a given route.  Apparently Right hand turn strategy saves millions in fuel cost and reduce the potential for traffic accidents.UPS had a problem, as it was faced with high injury rates and excessive turnover.  The company turned to its employees for solutions.  Lots of time was being wasted by sitting at busy intersection waiting for the opportunity to legally turn left.  Accidents where off the chart, as drivers who may have been running a little late would gun through intersections to make the light.  Cars in opposite directions would sometimes be in an equal hurry and jump the green light. Can you say CRASH!

Sound like a formula for disaster, but the company and its employees shared a common goal to implement safety strategies with a top-don management approach.  This has resulted in some significant operation and economic improvements.  May I remind you that Monday through Friday, UPS have almost 100,000 trucks per day on the streets.  The company has saved over 30,000,000 miles of travel for delivery drivers, The fuel saving is equal to about 3.5 million gallons annually while reducing toxic emissions by close to 75 million pounds. 

I can visually see in my minds eye as to how this would work for a company with lots of vehicles on the street daily, but I believe this would pose quite a challenge for you and I in our everyday commute.

OVER SIGNING A NAME vs. UNDER SIGNING

All the documents in a loan package should be signed exactly as the names appear on them. The full signature must be consistent throughout the loan package, even if there is no name typed under the signature line. The operative word from above is should, instead of must.  If the document and the identification are inconsistent, the identification presented will determine the signature a notary can witnessed. 

Given what was stated above, if loan documents are drawn using a customer's first name and their surname, make sure they are signed in that way.  If the documents are drawn to read first name, middle initial and surname, make sure they are signed that way. If the middle name is completely spelled out, it needs to be signed with the middle names spelled out in its entirety. 

If the documents are drawn under a trust, all signatures must be signed as typed followed by the word trustee. Example- John B. Doe, Trustee. 

A Power of Attorney lets you appoint a trusted person to manage important financial and legal matters on your behalf.  Following is an example of the signature requirement for a Power of Attorney, John B. Doe by Mary F. Doe, his Attorney in Fact or Jane E. Doe signing for John B. Doe as Attorney of Attorney.  Jane will sign her name as indicated on the documents, then where his name appears she will sign John B. Doe by Jane E. Doe, his Attorney in Fact. 

If you are not sure how the documents should be signed, contact the person who prepared the document for clarification.  Just remember, your notarial laws trump any intentions of the person who prepared the document.  This can be tricky territory, as you want to avoid the practice of law unless you are an attorney, yet help the client and provide a service. 

In a loan package there are documents, which must be notarized, and documents that only require a signature or witness.  All documents that require a witness do not always require a notarization.  Documents that require signature only may be signed as the names printed or typed on the document and on documents with no printed names, be consistent in the signature as stated above.

These are rules of thumb that will keep you from going back an obtaining the correct signature at a later time and save you on gas.

Whiteout is never to used on any documents!

As a public notary you will be called upon to witness many important documents that require a notary's seal of approval.  Never, never, never use whiteout to make a correction on any document Never use on a document to be notatized.for any reason.  I heard a "but" in the background from someone!  There is no exception or reason for whiteout, end of sentence. 

If there is a mistake by you or the customer, cross out the incorrect information using a single line (not scribbly-scratch like the kiddies) and enter the correct information. Always initial or have the customer initial any corrections or modifications to a document.

Just in case you didn't know.

The melody for Happy Birthday is copyrighted and not due to expire until 2030.  It is currently owned by Warner Brothers which earns more than $2 million USD per year, through enforcing its rights via ASCAP. Happy Birthday!

Here is the long and the short of it, if you sing Happy Birthday to your family and a few friends at home; you're probably have not committed any copyright infringement. However, if you perform that same tune in a bar, restaurant or club - and if the restaurant doesn't have an agreement to pay ASACP fees, you maybe engaging in copyright infringement.

It is unclear from my research as to who changed the lyrics to from "Good Morning to All" to "Happy Birthday". 

Note:  Too many friends and you maybe engaging in copyright infringement.  Warner Brothers seriously and agressively enforces their claim for ASCAP fees on Happy Birthday.  The United States copyright law in United States Code, defines publicly performing a work as "to perform or display it at a place open to the public or at any place where a substantial number of persons outside of a normal circle of a family and its social acquaintances is gathered."  They also sell the sheet music for $3.95 a crack over 115 years after it was first published.
