Negotiation is a vital and necessary skill

Negotiation is a vital and necessary skill for any realty professional who expects to be successful in the business.  However, many rookies and veterans as well struggle and flounder when opportunities to negotiate arises.

As a broad-brush definition, negotiating is a dynamic and interactive communication process that occurs whenever you something from another person and that person also seek something of you. There occur a communications that tries to find to arrive at a mutual ground to frame a shared understanding between the parties.

Many realty professionals are rotten negotiators or choose not to negotiate at all. Why is it that people who earning capacity and the essence of their profession require negotiating such poor negotiators?

It takes a little elbow grease!!!

Are Your Beneficiary Designations Updated?

When was the last time you reviewed or updated your beneficiary designation selection for your retirement plans, insurance policies or the last time you revised your will?  If it seems like ancient history, it is probably safe to say this would probably be an ideal time to review your selections to ensure that your wishes will are honored, if something unforeseen would happen to you. 

If you have small children and do not have a will, I would strongly suggest prioritizing this task on your laundry list of things-to-do, in short order.  Most people prefer not to think about this subject, but it is as much a part of life as breathing or walking. We just don't do it as often as we do the other aspects of living.  It is something if no done could cause severe hostility, internal strife and turmoil in a family after your demise.  And that is never a good thing!

Remember, you only need to revise or update or modify a new beneficiary form if you would like to update your beneficiary elections.  It can serve to create peace within a family. And, that is a great thing!

California ROCKS, especially Los Angeles County

We recently cracked the Top 100 on Activerain.  Today we cracked into the Top 10 in California; we've been sitting at the #5 spot in Los Angeles County for quite a minute now.

In reflecting on recently going over 150,000 points, I realized that California and Los Angeles County ROCKS

Marketable Title vs. Perfect Title

Title insurers some time choose to insure over and item of risk or insignificant flaw in the title to a parcel of real estate.  Lets say there is a unsatisfied mortgage that that shows on title that is over 50 years old.  They could request satisfaction of the lien that might take an eternity to obtain or realizing it is a lien that was not properly released and pose little risk can just insure over the lien to deliver marketable title instead of perfect title.

Talk About A Niche Market

There must be a significant slow down in the economy.  In Fontana, CA a bank employee inspecting a Marijuanaforeclosed home stumbled upon a grow house with $4.5 million dollars worth of marijuana growing inside.

Things must be so bad that the users don't have money to buy their medicine and the growers can't sell it quick enough to pay the mortgage on their farms. 

We have really fallen upon hard times!  It got to be tough times to have that much dope lying around and can't sell it to keep your monthly payment current.

Above is a composite of the various areas in which you will more than likely see a variety of questions from on the California Real Estate Agent’s and Broker’s Examination.


To pass the salesperson examination, examinees must answer a minimum of 70% of the test questions correctly. Broker canadiates must correctly answer at least 75% of the questions correnctly on their exam. The Saleperson’s exam is a one part exam and the Broker’s exam is a two part exam, morning and afternoon.


Remember above all else, the real estate exam is a reading exam, so read each question and all the given answers before attempting to figure out which answer is most correct. That aspect of the exam is often overlooked, the most correct answer. There maybe multiple correct answers, so select the most correct answer.


What I don’t like about the exam is that if you pass the exam, they won’t tell you your score. I struggled with the first question but the rest of the exam seemed like a breeze, but I was well prepared and had followed a ridgious study plan up unto the date of my exam. I remember that day like it was yeasterday as I had scripted that day in my mind and it worked exactly as I planned it from attending a pray vigil at 6:00 am that morning to having breakfast at 7:45 am and starting my exam at 9:00 am.


Study, prepare follow your program and have some fun as you learn and absorb this material. Make studying something you look forward to and challenge yourself to obtaining 80% scores or better on your practice test.

Is it Time for a Garage Sale?

Spring is a great time for a garage sale to get rid of all those things you have accumulating in your home or office that you'll never plan to use or things you no longer want.   When my children were small, I used an annual garage sale as an opportunity to stash some extra cash to fund our summer vacation.

A garage sale is not hard to prepare for and can be fun for the entire family!  It can also serve as a tax write-off, as you can make arrangements with a local charity to pick-up all the items left after the sale is over.

Current Impact of Predatory Appraisals

These statistics clearly demonstrate the reality of predatory appraisals in the marketplace. When Predatory Appraisals are used as the property value basis for a lending decision, the outcome is be the same for brokers, lenders, investors and borrowers - everyone loses.

In many cases as a trained underwriter, one could easily see with the adjustments to the comparables, that the appraiser was adjusting value instead of independently finding value.

The caveat is that lenders wanted the loans and politely overlooked any flaws with files, especially at the end of the month.  Depending on where you were relative to goal, managers would approve exceptions with expectation it would get through quality control. 

If the loan failed quality control, there was always the Scratch and Dent Department.  It was taboo to challenge brokers on the quality of documents submitted in a loan file, even if the preponderance of the evidence showed they were compromised.

As I often think back, I would probably had a best seller had I chronicled my observations and experience, while working for one of the largest lenders as both a Loan Underwriter and Account Manager.

Lots of money and fraudulent files were flying around and no one cared.  We had mortgage shops that specialized in arranging loans in for seniors and people in low-income neighborhoods and to immigrants, who understood our tolerance and pimped it to the max.

This is why we have a national mortgage, lending and money crisis today.  My mother would say, "What you do in the dark will eventually come to the light".  I'm not pleased to say, but her wisdom has proven true again!

This is inside info from Andrew Chang - Google Docs Marketing Manager that I thought I'd share with the community.  For those of you who don't know what Google Docs are.  They are Google answer to having Microsoft Office Suite of software online without having to pay for it.

Have you ever wanted to poll your website visitors on their interests or ask them for feedback on your site content? Now, using a Google Docs spreadsheet, you can create a simple form, collect responses from your visitors in an online spreadsheet, and publish the results on your
website -- in a few easy steps.

Google DocsAll of the data will be kept in your secure, password-protected spreadsheet. Here's how it works:

Create a new spreadsheet, build your survey form, and invite users to fill out the
form.

You can send out an email to people you'd like to fill out the survey (maybe to a mailing list you have), or generate some HTML code that allows you to embed the survey directly on your web page.

Your visitors won't need to sign in to Google Docs to fill out the form.

Responses are automatically added to your spreadsheet, and you can receive notifications by email when submissions occur.

You can even keep a closer eye on responses by adding the Google Docs forms gadget to your iGoogle homepage.

Finally, in your spreadsheet, you can create graphs and charts showing the results, and then publish those charts back on your site as gadgets.

As the responses trickle in, the published charts will update automatically. Check out the Google Docs Help Center for more detailed instructions on how to create your own
live survey.

When You Need A Notary Public

Certain situations and business transactions that we occasionally enter into require that we or another party notarize a certain document or types of documents in order for the document to be acceptable.

Under these circumstances an individual will require the services of a notary public. An example would be if a person wishes to transfer title to a motor vehicle to another party, the state Motor Vehicles Department required the transfer the document that certifies the transfer to be notarized.

A person seeking to obtain a mortgage or refinancing of an existing loan on a parcel of real estate will need a notary while executing the deed and certain other documents in the loan package.  Depositions, Notary Sealwills, trusts documents, powers of attorney, immigration forms and certain contracts require a notary's certification and approval, before they can be accepted in many states. 

If you need to provide written evidence for use in a court case, you may need to have your signed statement witnessed by a Notary Public. Also, some local jurisdictions may require you to provide evidence that you are free to marry which must be made via a declaration before a Notary Public.

A Notary Public is a public servant appointed under the laws of different states to witness the signing of important documents and administers oaths.  Notaries Public are legally empowered to take acknowledgments, oaths, and affidavits, and perform such similar acts, as may be specifically permitted under state law.  When a notary public authenticates a document they put their notary's seal on the document and also sign the document, in California under penalty of perjury.

Notaries in the United States have less authority than notaries in civil law jurisdictions or in most other common law countries.  U.S. Notaries are not allowed to give "legal" advice, but they are allowed to give notarial advice, with the exception of Louisiana. 

Notaries are usually prohibited (with the exception of Louisiana) from performing any functions that could be construed as the practice of law.  Activities include: the preparing, drafting, independently selecting the type of notarization a document requires, or the giving advice relating to any documents.

Notaries, by the very nature of their role as quasi-public officials are required by law to be persons of high moral character that display honesty and integrity in their dealings with others.  This moral character gives the public confidence in notaries, as others can rely upon them to be trustworthy stewards.

When you need a notary public to help you can easily find one online in one of the many notary portals online.  These notaries are usually independent business owners are will travel to meet you at your home, office hospital, jail or other place you request.  There is usually an extra fee required for travel services. 

You can also check with your local bank, credit union or in certain county or municipal offices.  Notaries who work in financial institutions and government offices usually are not mobile and it is to your benefit to book an appointment in advance, to avoid traveling to their office to find them at lunch, on vacation or out of the office for the day.

Your best bet in our opinion is to go online and Google "need a notary" and select a notary from one the online notary portals to save yourself from showing up at a business or government office only to be disappointed because no notary is in the office to service your needs.  It might cost a few dollars more but it worth not wasting your time in chasing down a notary public.
