FYI: The Big Roll Out

As many of you know California is rolling out 2 new laws on July 1, 2008, which, forbids motorist from talking on cell phones with out a hands free device.

One law applies to motorist over 18 years of age and the other law is applicable to motorist under 18 years of age.

To ensure motorist are enlightened the Amber Alert message boards on the freeway are providing warnings to drivers as they travel the highways and by ways of California.

Driving while talking on a cell phoneThat is to be expected as they introduce to a new fad.  What I'm about to share now, I don't know if many folks know about or expect to happen.

Some cities have recently purchased high-powered binoculars, video recorders and authorized baby-sitting for officers to make sure the public gets the message.

Officers will be working in teams to stop offenders who just don't get it.  One officer will be designated and positioned to lookout and observer for drivers who are using cell phones while driving.  If a driver is spotted they will radio ahead to a team of motorcycle officers who will be positioned ahead in the directions the driver is traveling.

The officers ahead will already know how long it will take you to reach their position along with the make of car and your license number.  Once you pass the designated point and are still on your phone, the officer will initiate a traffic stop.

The officer after asking for you license will ask you where you contacting on the phone making andTraffic stop emergency call to a law enforcement agency, a medical provider, the fire department, or other emergency services agency.  If you answer yes they will ask for you to show the last number called from your phone.  If in fact you are truthful will be warned about the new law and sent on your way with being cited.

If on the other hand you lie or say no, you will be issued a citiation.  If this is your first offense the base fine will $20.  If this is not your first offense the fine will be $50 for subsequent offenses.  If you notice I said base fine.  In California there is something called a penalty assessment which can cause the financial obligation to be more than triple the base fine.

A $20 fine becomes about $93 if you are convicted or plead guilty.  That $50 second offense fine will total more than $161 if you are found guilty, plead guilty or no contest.  No contest is the same as pleading guilty, except that it cannot be held against you I a civil proceeding.  I'm not an attorney, but I think this will only apply if there is a collisions and someone's property is damaged and you are sued in civil court.

The idea behind the use Day in Courtof enforcement muscle is to ensure that motorist get the message and refrain from driving and talking with a phone next to their ear and youth don't talk at all while driving.  Also they expect word of mouth to travel to help in assist in educating motorist while encourage drivers to be alert and not travel with phones glued to their ear.

I learned of this technique as I stoped by the park today to play a couple hands of dominos by someone who was recently stopped and given notice of the new law, as officers were testing their systems and communications.  Here is the premise, if you are on a cell phone without a headset, it is highly likely that you will still be on the phone once you pass the second checkpoint. People are creatures of habit and more than likely you will pass that checkpoint yapping away, until you see the christmas trees and hear the siren to alert you to pull over.

I hope none on Activerain site become an example, as enforcement will help some cities offset the cost of enforcement activities.  If you havppen to get cited, please share your experience with the community.

Hidden Adgendas

Today when you speak with business owners here, there and yonder, a few things are clear business is slow, profit margins are squeezed, and customers have hidden agendas.

I'm interested in hearing your stories of your conversations with business owners and what are they telling you.  The reason I selected business owners is they are the ones who enjoy some freedoms in a tight economy.

Also, have your clients approached you with hidden agendas in looking to buy or sell properties and how did you smoke it out?  I know your have some great stories about the drama Kings and Queens you have meet lately.  Please don't use names to protect the guilty.

Is there a hidden agenda to your business  (good or bad) that you comfortable sharing it in public?

We at needAnotary have a hidden agenda, which we will make public.  We are secretly amassing our website with a wide array of useful tools, resources and information that the general public and public notaries would be foolish to waste their time, energy or efforts going to another website when attempting to find a public notary.  Did you know we humanly verify the credentials of each and every notary public in our network?  Time consuming, yes.  But well worth our efforts.

Is that all, no!  We hope that more and more notaries would see the benefits and value in being in this notary public hotspot on the Internet and become members of our Traveling Professional Notaries team.  We also hope clients will be so excited about the services they receive from our notary members until they bookmark individual notary's Profiles pages on to their desktop for future reference and continual use our member's services.

A win-win-win for all:

  • The client gets good service,
  • The notary gets an income opportunity
  •  needAnotary adds another proud member in our network

Right hand turn strategy saves millions in fuel cost.

They say you live and learn and I've found that to be true in the course of life's events today I learned something new.  As I think while researching and before writing this blog, this must be a strategy that has something to do with going green.  Everyone is going green today!  Maybe that is whyWhat has Brown done for you lately? Boston won the Championship.  I'm waiting for the commercials, tongue in cheek.

I often notice as I pull up into an intersection whether there is glass or plastic or metal pieces lying in the middle of the intersections from a previous car crash, great way to get a slow leak or flat tire.  I was a bad boy once and was required to go to traffic school on a Saturday.  I spent the entire day in a hot crowded room listening to a guy trying to be funny when his jokes sucked.  But, I braved the experience and I learned something also on that day also.  The instructor said most traffic accidents occur in middle of intersections, especially when people making left turns.

Today I learned the UPS (What has Brown done for you lately?) uses a software program that pre-programs a driver's route in such a way there are no left turns or very few if any on a given route.  Apparently Right hand turn strategy saves millions in fuel cost and reduce the potential for traffic accidents.UPS had a problem, as it was faced with high injury rates and excessive turnover.  The company turned to its employees for solutions.  Lots of time was being wasted by sitting at busy intersection waiting for the opportunity to legally turn left.  Accidents where off the chart, as drivers who may have been running a little late would gun through intersections to make the light.  Cars in opposite directions would sometimes be in an equal hurry and jump the green light. Can you say CRASH!

Sound like a formula for disaster, but the company and its employees shared a common goal to implement safety strategies with a top-don management approach.  This has resulted in some significant operation and economic improvements.  May I remind you that Monday through Friday, UPS have almost 100,000 trucks per day on the streets.  The company has saved over 30,000,000 miles of travel for delivery drivers, The fuel saving is equal to about 3.5 million gallons annually while reducing toxic emissions by close to 75 million pounds.

I can visually see in my minds eye as to how this would work for a company with lots of vehicles on the street daily, but I believe this would pose quite a challenge for you and I in our everyday commute.

OVER SIGNING A NAME vs. UNDER SIGNING

All the documents in a loan package should be signed exactly as the names appear on them. The full signature must be consistent throughout the loan package, even if there is no name typed under the signature line. The operative word from above is should, instead of must.  If the document and the identification are inconsistent, the identification presented will determine the signature a notary can witnessed.

Given what was stated above, if loan documents are drawn using a customer's first name and their surname, make sure they are signed in that way.  If the documents are drawn to read first name, middle initial and surname, make sure they are signed that way. If the middle name is completely spelled out, it needs to be signed with the middle names spelled out in its entirety.

If the documents are drawn under a trust, all signatures must be signed as typed followed by the word trustee. Example- John B. Doe, Trustee.

A Power of Attorney lets you appoint a trusted person to manage important financial and legal matters on your behalf.  Following is an example of the signature requirement for a Power of Attorney, John B. Doe by Mary F. Doe, his Attorney in Fact or Jane E. Doe signing for John B. Doe as Attorney of Attorney.  Jane will sign her name as indicated on the documents, then where his name appears she will sign John B. Doe by Jane E. Doe, his Attorney in Fact.

If you are not sure how the documents should be signed, contact the person who prepared the document for clarification.  Just remember, your notarial laws trump any intentions of the person who prepared the document.  This can be tricky territory, as you want to avoid the practice of law unless you are an attorney, yet help the client and provide a service.

In a loan package there are documents, which must be notarized, and documents that only require a signature or witness.  All documents that require a witness do not always require a notarization.  Documents that require signature only may be signed as the names printed or typed on the document and on documents with no printed names, be consistent in the signature as stated above.

These are rules of thumb that will keep you from going back an obtaining the correct signature at a later time and save you on gas.

Whiteout is never to used on any documents!

As a public notary you will be called upon to witness many important documents that require a notary's seal of approval.  Never, never, never use whiteout to make a correction on any document Never use on a document to be notatized.for any reason.  I heard a "but" in the background from someone!  There is no exception or reason for whiteout, end of sentence.

If there is a mistake by you or the customer, cross out the incorrect information using a single line (not scribbly-scratch like the kiddies) and enter the correct information. Always initial or have the customer initial any corrections or modifications to a document.

Just in case you didn't know.

The melody for Happy Birthday is copyrighted and not due to expire until 2030.  It is currently owned by Warner Brothers which earns more than $2 million USD per year, through enforcing its rights via ASCAP. Happy Birthday!

Here is the long and the short of it, if you sing Happy Birthday to your family and a few friends at home; you're probably have not committed any copyright infringement. However, if you perform that same tune in a bar, restaurant or club - and if the restaurant doesn't have an agreement to pay ASACP fees, you maybe engaging in copyright infringement.

It is unclear from my research as to who changed the lyrics to from "Good Morning to All" to "Happy Birthday".

Note:  Too many friends and you maybe engaging in copyright infringement.  Warner Brothers seriously and agressively enforces their claim for ASCAP fees on Happy Birthday.  The United States copyright law in United States Code, defines publicly performing a work as "to perform or display it at a place open to the public or at any place where a substantial number of persons outside of a normal circle of a family and its social acquaintances is gathered."  They also sell the sheet music for $3.95 a crack over 115 years after it was first published.

Smile song

Smile awhile and give your face a rest

Stand up straight, and elevate your chest

Raise your hands up to the sky

While we sway our heads so slowly

Turn around and limber up a bit

As you were, and now before you sit

Reach right out to someone near

Shake a hand and smile

Don't tell God how big your mountain is...

...tell the mountain how big your God is.

This inspired me and I thought it was worth sharing! Hope you have an absolutely marvelous rest of your day!

BECOME A NOTARY SIGNING AGENT - Build Your Own Successful Business

BECOME A NOTARY SIGNING AGENT

Build Your Own Successful Business.

Becoming a Notary Public Signing Agent is one of the best ways to work from home, have flexible hours, and earn a fantastic income.

Mobile Notaries are self-employed business people who work for themselves and provide a vital service to their community. Not only do they provide a vital service required in any economy that depends on commerce and free trade. This is an ancient concept and there are certain documents, which are not valid without a notary's seal of approval.

History lesson

The ancient Egyptians and Greeks employed notaries in Biblical times. Latin 'SCRIBAE' - these clerks or scribes who took notes and minutes of important meetings, events, and decisions from the ruling authority. They also made copies of both Public and Private documents. The Notary Public is a quintessential ancient officer whose principal duty it was to witness the signing of important documents and to administer oaths.

This create and opportunity for you to start a business that is easy to operate, low overhead and start-up cost, flexible hours and you get to meet lots of people. Being a notary is also a great part-time opportunity for someone going to school, senior citizens and retirees, stay at home moms, those in transition or while changing careers, those who have free time would like to earn a few extra $$$, network in social circles and just have a little fun.

If you want to:

  • Be Your Own Boss
  • Work Full-Time or Part-Time Hours
  • Work From Home
  • Make a Few Extra Dollars Monthly
  • Work Part Time Making Full Time Wages
  • Have a Flexible Schedule
  • Earn Extra Money to Get by in Difficult Times
  • Fund Your Retirement, a College Education or as a Charitable Gift
  • Meet New People in Business and Social Settings
  • Be an Icon in Your Local Community

Being a notary public is a great career choice for many individuals and in most cases can advance your career development, as it gives you an additional skill set and the opportunity to earn some extra income to pursue your ambitions.

There are certain fundamental skills you will need to learn and acquire to be effective and successful while not exposing yourself to undue liability or risks.

First you will have to become familiar with the process and procedure for becoming a notary in your local jurisdiction. It is different everywhere, you need to check your specific rule but contacting the authorizing department. If you want to link to your state's official notary authority website, click here.

As you work thorough the process to become a notary public, become familiar with what a notary is and the duties to be performed in your state by a notary. Rules are different from locality to locality. Discover how documents are to be correctly notarized. This is also a perfect time to start brushing up on your people skills. You'll need them!

Once you get your license or commission, it will be time to go to work. I strongly suggest you find a mentor for the first 3 to 6 months in the business. It might cost you a few buck, but it can be the best investment you make in your career. I strongly prefer this approach to any class you can take. It can have a lasting effect and you will have at least one friend in the business when you're finished.

Mentorship will give practical insight in dealing with unusual situations, controlling the appointment, opportunities as a loan signing agent, how to locate clients, vocabulary, setting your fees, running your business, and much more. Expect to pay about $300 for a good mentor, who gives you quality one on one time.

If you add Loan Signing Agent to your resume, it is reasonable to work 10 hours per week, and charge an average of $150 per appointment; you would earn approximately $50,000 per year. There are few other opportunities that allow you to earn that much so quickly. A Loan Signing Agent is simply a Notary Public who has specialized training and is familiar with common legal documents, and in the presentation and notarization of mortgage loan documents.

Getting a notary commission is relatively simple and easy, but building a truly successful notary practice will take some time and specific actions, to be realized. It's actually a very easy and fun business as long as you know what is expected of you, you deal in integrity and don't waste your valuable time on marketing that yield zero results.

Every thought of becoming a Notary Public

Okay, So you just passed you Notary exam or you already hold a notary commission, what is next.  Have you considered putting your newly acquired skills to use as a Mobile Loan Document Signing Agent?  Please don't put that title on your business card, as it is too long.

First you have to get all the supplies you'll need for your notary bag, you will need to find a mentor to coach and train you for a short period of time.  I don't believe in the various training classes, especially those offered through the NNA (National notary Association).  You'll need a soul where you can call when you're in the field and something doesn't make sense.  Consider finding and experienced notary and offering to give them the same money you would give the NNA for a course. You'll make a friend and be better served for your efforts.

You can find many qualified mentors on needAnotary.net who would gladly train you in the nuances of notarial practices.

You'll need some business cards.  Keep them exciting but simple and put your contact info in a 13-point font.  Remember many people have a hard time reading letters too small and close together. Make it easy of people to see your email address and URL.  notaryinillinois@resceg.com.  Notice how is the font is too small it is hard to distinguish the "i", "l", "s" and "c" when they are very close together.

One of the sweet parts of being a mobile notary is that you get to set your own hours.  Remember you are a self-employed businessperson and you have to treat your business like a business and not a hobby.  You'll need a marketing plan, regular working hours, a quality control system and a business website.

7,000+ points in one day!

Yep, we scored 7,000 point yesterday.  20 invitees, 10 comments and 3 blog postings.

It is possible to have big days on Activerain.  Absolutely, you have to contribute thou.  Believe it or not we don't blog because we like to.  Don't believe that (lol), we blog for our notary members.  We know our efforts create clicks for them and isn't that really what it is all about.

When their notary profile gets clicked, we know there will be a happy customer and a pleased notary.  Plus, customers and notaries satisfiaction breeds renewed confidence in our web portal.

Yes, you can earn 7,000 points in one day.  I'm sure there maybe some who have earned more points in a single day and I would commend them for their efforts, if I knew who they were.

How to Get Care You and Treatment at Veteran Affairs and VA Facilities

How to negotiate the Veteran's Affairs and VA Facilities

I was responding to a blog and realized that I was passing along some valuable info.  So I decided to post a blog of my own on that topic.

I'm a Marine (during the Vietnam Era) and have used the VA system for almost 40 years.  I actually did work-study while I was in college. I worked with quadriplegics and helped them with their rehab assignments.

If you are a Veteran considering joining an organization, select one from this blog, click here.  If you need representation in filing a claim or appeal, they can help you.  You will be asked to sign a POA (Power of Attorney).  I personally use the DAV.  American Legion is good, as I also belong to Jackie Robinson Post in Los Angeles.

I can personally attest that a claim or appeal may take 4 to 5 years but you need to read all paperwork and respond to any and all deadlines.  If you're not careful, they will get you on deadlines.  Keep your address current so you get your mail.  Consider a post office box to vs. trusting friends and family.  Remember that that pay you from the date you claim started.  That could mean thousands of dollars in back pay!

If you are Veteran getting out of the military, consider joining one of the service organizations after your discharge.  Yon can meet a lot of people that can help you, if you ask.  Asking for help is very important!  Also, VA hospitals have a canteen like in the military where you don't pay sales tax on merchandise.  This can save you lots of dough on high-ticket items.

There are some good doctors and some crackpots at medical facilities. If you feel something is wrong or uncomfortable, ask for another doctor or medical provider. It is right and your health. Don't waste time getting upset when things don't go right. Always ask important question in two or more different ways. Nothing is wrong with sounding silly or stupid if you have health issues.

Keep your DD-214 and / or VA card available when you visit VA facilities.

Starting a Notary Public practice is simple

Find a notary public on need A notary

"Success is a Choice; Are you ready to make that decision? If so, when?"

- Owlism

Starting a Notary Public practice is simple to do and does not require a large outflow of cash to get started. I would suggest getting a high-power website and delivering quality service when you start to build a sound business.

Stray away from working with signing services as they sometimes don't pay or pay late, like 30, 60 or even 90 days after work has been completed.

Now you know why!

Notaries Beware:

Please review this price list I found from a title company offering closing services.  They have listed a notary fee of $150 without a notary's concurrence. I have a big problem with outside agencies establishing my fees for my business.

No other professions allow third parties to establish their fees like notaries.  In California if a signing require 6 documents in the package to be notarized by 2 parties and your minimum travel charge is $50, the total cost would be $170. $20 may not sound like much but multiply it by the number of signings you performed last year.

However, this company has set a fee below your minimum fee.  Attorneys, accountants, plumbers, real estate agents, loan officers and no other group of professionals, who approve of another party setting the fee they charge.

Why do notaries bite the bullet?  I hope this is a wake-up call for notaries to see how they are being victimized and refuse to accept assignments in the dark without regards for the profitability of the assignment.

If a company don't control its own pricing, it can't control it profits. I would hope this real example point out what we at www.needAnotary.net have been preaching for over 5 years.  To operate a mobile notary business, you need to price your services and not have fees dictated to you by others.

I know individual notaries will do as they damm well please, but I hope they understand the consequences of their actions and how it effect the market rate for fees and the impact of their decision on the industry as a whole.

For many years, accountants and attorneys were prohibited from advertising fees Jacoby & Meyers broke the mold and started advertising fees.  Since then fees for all (except the high-end) lawyers have decreased.  Most states have mandates on notary fees and many notaries are charging fees well below the state's mandate and not being profitable.

Writing a robots.txt file is, as you have seen, a relatively simple matter. However it is important to bear in mind that robot.txt files are not a security tool. They may be used to stop specified pages from appearing in search engines indices.  There are many hundreds of bots and spiders crawling the Internet now and while most will respect your robot.txt file, some will not and there are even some designed specifically to visit the very pages you are specifying as being out of bounds.

JOKE OF THE DAY | QUOTE OF THE DAY

JOKE OF THE DAY

Real newspaper headlines

These are actual newspaper headlines gathered from papers across the United States and world.

British Left Waffles on Falkland islands

Lung Cancer in Women Mushrooms

Eye Drops off Shelf

Teacher Strikes Idle Kids

Reagan Wins on Budget, But More Lies Ahead

QUOTE OF THE DAY

Leadership is solving problems. The day soldiers stop bringing you their problems is the day you have stopped leading them. They have either lost confidence that you can help or concluded you do not care. Either case is a failure of leadership.

What is RSS all about?

RSS aggregators are quite popular in the web blogging community. RSS is a text-based format, a type of XML. The initials "RSS" stand for the following XML file formats below:

Really Simple Syndication (RSS 2.0)

RDF Site Summary (RSS 1.0 and RSS 0.90)

Rich Site Summary (RSS 0.91)

It is a way to simple means to distribute a list of headlines, updates, and fresh content to a wide distribution of people automatically.  It is used by computer programs that organize those headlines and notices for easy reading.
